If I could find a copyright anywhere on the package I would partially agree, but I can’t — anywhere. In all cases that I can find settled on this point to date two things arise.

  1. The school’s media contract (which I opted of out anything than directory sharing and sharing with colleges and universities.
  2. Anytime a minor’s picture is used for commercial means it requires parental consent.

The photographer simply didn’t have permission to take the shot or use it for commercial means. I am addressing with the school that the school and the photographer are both in violation of the media contract.
